Climate Camp come to NewhavenClimate Camp will be travelling along the South Coast and up to Kingsnorth in Medway, Kent via a human caravan that will be travelling by foot and public transport, bike, float and boat, including veggie oil recycled vehicles. They will have events during the day and on some nights they will be camping overnight. They will traverse this distance over 9 days, arriving at Climate Camp, which will be at the Kingsnorth Coal fired Power Station. High Court action, please come along!There will be a Judicial Review aimed at quashing the Incinerator Planning permission at the Royal Courts of Justice on the 21st and 22nd of July starting at 10:30 am on Monday the 21st. It's a 49 seater coach leaving on Monday 21st July departing at 0730, pick up point Sainsbury Newhaven. The coach will leave London at 1630hrs. DOVE holds a successful Open MeetingIt was a well attended open public meeting with approximately 100 people representing Newhaven, Seaford, Bishopstone, Piddinghoe/ surrounding areas and Brighton. There was representation from the local Councillors and political organisations. Newhaven Police sent along a uniformed officer to attend and listen to the feelings of the People.
It was a lively informative meeting, the outcome of which was the clear message that the Incinerator is far from a 'done deal' and the fight to seek justice and stop the incinerator is definitely alive and moving forward.
There were a lot of proactive and good ideas from the floor for fund raising and getting the 'word out' to the wider community, Dove hope to co-ordinate with the members and move these forward.
Dove thanks all who attended and shared their ideas and expertise. Dove with the continued support of the members are committed to stop this out dated method of Incineration and make sure that the wider community have a voice, are not ignored by East Sussex County Council & Brighton City Council and their elected (decision making) Councillors.

Veolia Attempt Psychological Warfare on Newhaven Population in Arrogant Disregard of Due Process East Sussex County Council claim to have negotiated terms on all the leaseholds of the parcels of land at North Quay in order to start building their Incinerator (see paragraph 2.3 of C3Jun2008Item8CPO1.pdf). Because of this they say they do not require the Compulsory Purchase Order and so do not want the Inspector’s Report to be published. We suspect the draft Inspector’s Report does not support the Compulsory Purchase and that some of the reasoning for that lack of support may well enhance our legal case against the planning application. We have made a request for a copy of that draft report.
Veolia have started to clear the site at North Quay and are putting in place equipment to start cleaning up the contaminated top 4 metres of soil which they must do prior to any construction work (see photos below). 

Temporary accommodation for the anticipated 260 strong construction workforce (which will come in from outside this area) has been put in place on land adjacent to the incinerator site. This comprises 50 portakabins in double storey format as shown in photo below. 
We have consulted our legal team with regard taking out an injunction against any further work being done. Veolia would normally argue that their financial investment in the clean up operation puts pressure on the courts to allow them to continue and go ahead and build the incinerator even if it is shown that the planning permission for this mass burn technology is flawed. We have effectively pre-empted this tactic. In fact, because Veolia are continuing to invest time and money at this level without having a valid Pollution Prevention Certificate and in the knowledge that permission is sought to challenge the planning permission through the courts, their arrogant “ploughing ahead” in this fashion may well count against them. We consider that they would be foolish to actually start construction unless and until they have a valid Pollution Prevention and Control Permit and the legal challenges from DOVE, Newhaven Town Council and Friends of the Earth have been done. You may have already heard about these things or seen evidence yourself if you use the public footpaths along the river bank. These actions are all designed to firm up the idea in the minds of the local population that the incinerator is now a certain “done deal” and that any further protest or resistance would be futile. We are not alone in our continuing strong belief that moving from landfill to mass burn incineration at this throughput for East Sussex and Brighton & Hove is not the right choice for the next 50 years. We will continue to try to avert it by all available means and we need your undaunted support. Nil illegitemi carborundum!

Day has managed to quash the incinerator operating permit, this will be very helpful in stopping the compulsory purchase of the land to build the incinerator, it will also assist in quashing the planning application. We know that it is not the best time of year to ask for money but DOVE has now joined forces with Ms N. Day in a legal challenge to quash the planning application for the Newhaven Incinerator; we need to raise at least £20,000 to fight this legal campaign. DOVE member Nicki Day quashes incinerator pollution permit, the first time in legal history!On 5th December 2007 the High Court quashed the pollution permit for a proposed £150 million municipal waste incinerator at Newhaven because the Environment Agency failed to properly assess carbon dioxide emissions from the plant. Veolia ES South Downs Limited intend to construct an Energy Recovery Facility to burn over 210,000 tonnes of waste per year from East Sussex and Brighton and Hove. In doing so it would produce 107,000 tonnes of carbon dioxide per year. The Environment Agency granted a pollution prevention and control permit (PPC permit) for the incinerator in November 2006. Judicial review proceedings were brought by a local resident, Mrs Nicki Day, to quash the permit. The day before the trial of the case was due to start, the Environment Agency and Veolia agreed that the permit was unlawfully granted and should be quashed. Mrs Day argued that because of the effects of carbon dioxide in increasing climate change it was a pollutant. Consequently the Environment Agency were obliged to consider whether this pollution was acceptable and to impose a limit on the amount of carbon dioxide emitted or impose some similar restriction. The Environment Agency initially resisted the proceedings, and the climate change point, but shortly before the hearing they accepted that they needed to give further consideration to carbon dioxide emissions and had given inadequate reasons on the issue. Veolia agreed and the permit was quashed by Mr Justice Sullivan. The case establishes that pollution permits should be used to limit or prevent carbon dioxide emissions from industrial facilities (where emission trading does not apply). The operator and the Environment Agency had argued that the effect of the incinerator on global warming was insignificant and that the rise in sea level would be ‘infinitesimally small and far beyond any plausible means of estimation’ so was not a problem. They now accept that this approach was inadequate. The case also raised issues of the effect of an admittedly defective advertisement, whether responses to the environmental statement should be considered by the Agency and visual and emissions impacts on the adjacent area of outstanding natural beauty and countryside. Mrs Day was represented by John Dunkley of Earthrights Solicitors and barrister Richard Harwood of 39 Essex Street Chambers. Many congratulations Nicki! |

Water abstraction and discharge for constructionHochtief (UK) Construction Limited and Hochtief Construction A.G. are seeking a licence from the Environment Agency to allow them to abstract water from the River Ouse Estuary at North Quay to be used for industrial process water during the construction period of the Newhaven Incinerator and a Trade Effluent Discharge Permit to allow them to put that water back into the river after use.
